Pursuant to Section 266 of The Education Act, 1995 (The Act), all Saskatchewan boards of education and the conseil scolaire are required to make application to the Educational Relations Board (ERB) to have a teacher designated as out-of-scope, that is, as not being a teacher within the meaning of Sections 234-265 of The Act. This includes hiring to replace a person in an existing position, to fill a new position, and moving a person to another administrative position within the school division or conseil scolaire that requires a change in responsibilities. A new job description must be reviewed by the Educational Relations Board.
A person who has been designated as not being a teacher also may apply to the ERB to be designated as a teacher.
The Educational Relations Board has the duty and responsibility to adjudicate applications and oversee the balance in the ratio of out-of-scope administrators to the number of teachers in accordance with the criteria defined in Section 9 of the Provincial Collective Bargaining Agreement between the Boards of Education and the Government of Saskatchewan and the Teachers of Saskatchewan (PCBA).
In accordance with Article 9.1.1 of the PCBA, a board of education and the conseil scolaire must demonstrate that the named individual is no longer working as a teacher. Out-of-scope applications should be received at least one week prior to the meeting date to be considered. The parties to an application will normally be notified within five weeks of the ERB meeting.
