The Educational Relations Board is a five-member board that is established to address labour relations issues in the Saskatchewan education sector, specifically disputes arising related to local and provincial contract negotiations and implementation, and the balance of out-of-scope and in-scope personnel in school divisions.
The Educational Relations Board (ERB) is created by The Education Act, 1995, which assigns duties and responsibilities to the ERB. The primary activities of the ERB deal with:
The appointments of mediators, conciliators, or arbitrators, as required and as outlined within The Education Act, 1995;
Assisting with the identification of Chairpersons to hear grievances arising from the Provincial Collective Bargaining Agreement;
Adjudicating out-of-scope applications based on the managerial tasks undertaken by the former-teachers, and
Ensuring the number of out-of-scope approvals do not exceed ratios of teachers-to-school division administrators agreed to by the Parties of the Provincial Collective Bargaining Agreement as per Article 9.
The Educational Relations Board is established by section 241 of The Education Act, 1995. The work of the ERB is directed and governed by sections 242 to 269 of The Education Act, 1995.
Remuneration for the members of the Educational Relations Board are specified in Table 4 of The Education Regulations, 2015.
Section 9 of the Provincial Collective Bargaining Agreement defines the criteria which must be met for the Educational Relations Board to designate a teacher as being out-of-scope. These criteria are related to the duties of the person and to the ratio of teachers to out-of-scope personnel in the school division.
Section 15 of the Provincial Collective Bargaining Agreement (PCBA) allows an arbitration board hearing a grievance related to the PCBA, to extend the time limit specified in Section 15 of the PCBA by mutual consent or with the concurrence of the Educational Relations Board.
